Aborigines and Nexus face off in court over bypass

A TEMPORARY injunction that has stopped works at two sites on the Toowoomba Second Range Crossing will be the focus of a hearing of the Land Court today.

The Land Court granted an interim injunction to Western Wakka Wakka man Adrian Beattie on Wednesday afternoon and the matter is listed for review in the court at 2.30pm.

The injunction will expire at 6pm.

The injunction is related to what Mr Beattie says are bora rings near Charlton and an ancient lookout at Murphys Creek.

He fears that construction works will damage the culturally-significant sites.

The Department of Transport and Main Roads, which is managing the $1.6 billion project, has said archaeological studies did not provide evidence for the sites.

Mr Beattie has been self-represented in the matter and the court has reserved costs.

Bora rings are a sacred place where some indigenous tribes perform initiations rituals.

The rings in Charlton are on a property between Holmes Rd and the Warrego Hwy.

There are anecdotal reports grass hasn't grown at the site of the rings for more than 100 years.

The ancient lookout is said to be a signalling station of cultural significance in the Helidon Hills area.

The site was used by indigenous Australians during wars against the Europeans who were settling in Australia, according to an Aboriginal heritage consultancy group.
